LEXINGTON, N.C. (WGHP) — A roadside memorial has been set up for an 8-year-old who died after a crash last week.

Amber Whitaker had four kids under the age of 16 in her vehicle. She was watching two of them at the time, two of them were her own.

Whitaker appeared in court on Monday and has been charged with driving while impaired, driving with a suspended license, felonious death by motor vehicle and felonious causing serious injury by motor vehicle.

During her appearance, they said that Whitaker could face up to 36 months in custody for the DWI, 304 months for the death by motor vehicle and 59 months for the serious injury charge.

An 8-year-old girl, Jayden, died in the crash.

Jayden’s mother, Brandi Nichols, has known Whitaker since the seventh grade and had let her take care of her children often. Jayden’s 15-year-old brother Gabriel was also injured in the crash.

Court documents FOX8 obtained show the driver, 35-year-old Whitaker, was impaired and had taken methadone. Lexington officers said Whitaker’s speech was slurred and she nodded off during questioning.
