DURHAM, N.C. — Novelist Michael Peterson is set to appear in a Durham courtroom Tuesday for a hearing as his case moves closer to a new murder trial.

According to the Durham Herald Sun, Peterson’s lawyer also plans to ask that his electronic ankle bracelet be removed. The bracelet monitors his location 24 hours a day.

Peterson was convicted in 2003 of the 2001 killing of his wife Kathleen in their Durham home. He was sentenced to life in prison, but was let out in 2011 after Superior Court Judge Orlando Hudson ordered a new trial.

Judge Hudson ruled that SBI blood analyst Duane Deaver gave false and misleading testimony at Peterson’s first trial, according to WTVD.

Kathleen Peterson was found at the bottom of a bloody staircase in the couple’s mansion, but Peterson has maintained his wife died in an accidental fall after drinking alcohol and taking Valium.
