Greensboro martini lounge sued for trademark infringement

GREENSBORO, N.C. – A West Palm Beach, Fla., lounge is suing a local martini bar and lounge for trademark infringement, according to the News & Record.

Blue Martini Founders, LLC is suing Best 318 Inc., Jorge Felix Rivero Prado and Luis Mangual Torres, operators of Blu Martini bar and lounge at 318 S. Elm St.

Blue Martini Founders also is suing for federal unfair competition and violation of North Carolina unfair and deceptive trade practices. The company wants a jury trial.

In its complaint, filed Aug. 28 in U.S. District Court in Greensboro, Blue Martini Founders said it is the owner of the Blue Martini trade name and trademark, which it has been using since at least 2000 in the advertising and promotion of its restaurants and lounges. Blue Martini Founders lists its primary location in West Palm Beach, but has lounges in several locations in Florida, including Boca Raton, Fort Lauderdale and Miami, as well as in Phoenix and Las Vegas.
