Guilford Co. Board of Education, GCS Supt. file suit against state teacher tenure law


GREENSBORO, N.C. — The Guilford County Board of Education, GCS Supt. Maurice O. Green and the Durham Public Schools Board of Education filed suit Monday afternoon in Guilford County Superior Court.

The lawsuit asks the court to declare that the state legislature’s retroactive invalidation of contractual teacher tenure rights granted by GCS and other local school boards is unconstitutional.

The suit stems from the legislative mandate requiring school boards to ask 25 percent of teachers to relinquish their vested tenure rights by June 30, 2014 in order to secure a four-year contract and potential bonus of $500 per year.

Gov. Pat McCrory said on March 5 he is looking at whether he would like changes to the law.

Other groups have challenged the constitutionality of the mandate in recent months.
