MARION, N.C. — Marion police have dropped a murder charge against a man after learning the victim was alive.

Detectives learned several hours after the murder charge was filed against 27-year-old Christopher Michael Edwards of Marion that the 20-month-old girl had not died.

Lt. Scott Spratt says Edwards is charged with felony child abuse inflicting serious injury. It was not clear if he has a lawyer.

Police say Edwards is the boyfriend of the toddler’s mother. Lily Anne Kerr was taken to Mission Hospital in Asheville with head trauma Wednesday.

Spratt says officers charged Edward with murder Thursday morning after being told by the hospital the girl had died.

Spratt says the charge was dropped several hours later after learning the girl was alive.

It’s unclear how the incorrect information got to police.
